Disclaimer:

1. Project ECOCABS shall make sincere efforts to provide better cycle rickshaw facility to the residents of Chandigarh. Notwithstanding the same, Project ECOCABS does not hold any responsibility regarding the information made available on this website or any services provided under the name and brand of “Project Ecocab”. Any consequences arising out of the usage of this service like road accident, misconduct by rickshaw operator, delay in service, unsatisfactory service etc are not liable for any legal claim whatsoever to the Project Ecocab.
2. The Project ECOCABS does not provide services of rickshaw transportation, and serves only as an intermediary in order to facilitates an interface between the RICKSHAW DRIVER and the USER/PASSENGER of the rickshaw service. Thus, by accepting the provision of services by the individual rickshaw driver, the USER/PASSENGER acknowledges that the Project ECOCABS has no direct link with the rickshaw and only facilitates contact between DRIVER and PASSENGER. You acknowledge and agree that Project ECOCABS shall not be liable for any acts or omissions of any users, whether by robbery, loss of commitment as a result of any act, or omission, and others including the effective fulfilment of the obligations assumed by the user/passenger, not being exhaustive list of these losses. The user/passenger acknowledges and agrees that, by registering and accepting the policy of the service, he/she does so at his/her own account and risk.

Terms of Service:

1. Project ECOCABS does not guarantee that the system will be available without interruption, or that it will always be free of errors and cannot therefore be liable for damages caused to users/passengers.
2. Project ECOCABS shall not be responsible for any damages or losses caused to your computer as a result of using the Website, mobile application and any other tools used by Project ECOCABS in providing its services.
3. The USER/PASSENGER agrees and acknowledges that the use of the services offered by Project ECOCABS is at the sole risk of the USER/PASSENGER and that Project ECOCABS disclaims all representations and warranties of any kind, whether express or implied as to condition, suitability, quality, merchantability and fitness for any purposes are excluded to the fullest extent permitted by law.
   Without prejudice to the above, Project ECOCABS makes no representation or warranty that:
   1. the service will meet your requirements;
   2. the service will be uninterrupted, timely, secure, or error-free.
4. Project ECOCABS shall not be responsible or liable for any loss or damage, howsoever caused or suffered by the USER/PASSENGER arising out of the use of the dial-a-rickshaw service offered by Project ECOCABS or due to the failure of Project ECOCABS to provide services to the USER/PASSENGER for any reason whatsoever.
5. Project ECOCABS shall be entitled at any time without giving any reason or prior notice to terminate its services.
6. All terms and conditions are subject to the laws of India. The disputes, if any, will be subject to exclusive jurisdiction of the Courts in Chandigarh.
7. Project ECOCABS does not guarantee any interruptions in the dial a rickshaw service and the journey itself, including as a result of weather, traffic, road conditions, mechanical problems or any other conditions beyond our control.
8. Project ECOCABS is not liable for any inconvenience or expense caused as a result of such delay.
9. Project ECOCABS assumes no liability or responsibility for injury, loss, or damage to persons or property, delay, or expense arising from or caused by weather conditions, acts of God, war, accident, government restrictions or regulations, from an act or omission of any individual, traffic, road conditions, mechanical problems, or any other cause or condition beyond our control.
10. Project ECOCABS is not responsible for the quality and safety features of public and private transport.
11. Project ECOCABS is not responsible for lost, stolen or destroyed personal effects.
12. The USER/PASSENGER acknowledges and declares that he/she understands and is aware of all the risks involved in the use of the Website and/or mobile application and contracting services, pledging to take care reasonably expected of someone choosing a rickshaw to transport it.
13. The USER/PASSENGER acknowledges and agrees that Project ECOCABS performs no selection of Rickshaw Drivers and simply enrols them by their registration on the website and/or mobile application to join, and does not vouch for their suitability or their legal capacity, physical or mental health to provide the Services.
14. The USER/PASSENGER acknowledges that the data released by the RICKSHAW DRIVER , such as: (i) vehicle details, (ii) full name, (iii) profile picture, among others, were provided by the DRIVER or a third party. By accepting the Services, the USER/PASSENGER acknowledges that Project ECOCABS has no involvement in the contractual relationship between RICKSHAW DRIVER and USER/PASSENGER.
15. Project ECOCABS shall not be responsible for any damage, malfunction or problems caused due to or as a result of or consequence of the use, download inter alia of the mobile application of Project ECOCABS, namely "Chandigarh Ecocabs".

License:

1. The Project ECOCABS grants the USER/PASSENGER a limited, personal, nonexclusive, nontransferable, non-commercial and fully revocable license to use the Website and/or mobile application on your mobile or computer all in accordance with the terms contained in this Agreement. The Project ECOCABS reserves all rights not expressly granted herein Website.
2. The Project ECOCABS is not liable for damage suffered by the User who has copied, transferred, distributed or otherwise used in this Website protected content, violating rights of third parties.

General Conditions:

1. These Terms of Service agreement generates no society, office, franchise, or employment relationship between the Project ECOCABS and the USER/PASSENGER or the RICKSHAW DRIVER.
2. These Terms of Service may be modified by Project ECOCABS anytime. The changes will come into force automatically on the date of publication of the new version on the Website.
3. These Terms of Service shall be governed by and construed in accordance with the laws of the India and any disputes arising out of these Terms which can not be amicably resolved by parties, shall be submitted to the jurisdiction of the Chandigarh.
4. By using the service, or registering as a RICKSHAW DRIVER or USER/PASSENGER in the system and electronically accept this Term, by clicking the "I accept the terms of use", the User states automatically and unconditionally agree to these Terms and any other policies and rules available in System.
